These Terms & Conditions (“Terms”) govern use of himvalley.in (the “Website”) operated by HimValley. The Website lets travellers search and book verified homestays (“HomeStays”) in Himachal Pradesh and lets hosts list and manage those stays.
By using the Website, creating an account, listing a property or completing a booking, you agree to these Terms and to our Privacy Policy.
1. HimValley’s role
HimValley is a platform. Hosts, not HimValley, provide accommodation. We do not own the properties listed. We may review listings before they are published, but we do not guarantee every stay, photo or amenity. A booking is a contract between the guest and the host, facilitated through the Website.
2. Accounts
- You must provide accurate information and keep your login details safe.
- Guests, hosts and administrators have different access. Hosts use the vendor dashboard to manage listings, rooms and bookings.
- We may suspend an account that is misleading, abusive or used to avoid these Terms.
3. For guests
- Check location, house rules, capacity and cancellation information before you book.
- Pay through the methods offered on the Website. Do not transfer money privately to skip confirmation.
- Arrive and leave at the agreed times, treat the HomeStay with care and follow local laws and host rules.
- You are responsible for all guests in your party, including children.
- Reviews must be honest and based on an actual stay.
4. For hosts
- Only list properties you are entitled to offer. Descriptions, prices, photos and location must be accurate.
- Listings remain unpublished until HimValley approves them. Draft or pending locations (including “Other” locations you suggest) are not shown to guests until verified.
- Honour confirmed bookings and keep availability up to date.
- Follow Himachal Pradesh homestay and tourism requirements, including any registration or tax duties that apply to you.
- Read our Host Guidelines. Repeated breaches may lead to removal of a listing or account.
5. Bookings, cancellations and refunds
Prices, taxes and fees are shown at checkout where applicable. Cancellation and refund rules depend on the listing and the status of the booking. If a host cancels, HimValley will try to help you find another stay but is not obliged to provide alternative accommodation. Chargebacks or payment disputes must be raised promptly with support.
6. Payments and payouts
Guest payments and host payouts are processed through the payment options enabled on the Website. Hosts are responsible for any tax on income they earn. HimValley may withhold or delay a payout while we investigate a dispute, suspected fraud or a cancelled stay.
7. Content and intellectual property
HimValley branding, Website design and original content belong to HimValley. Hosts grant us a licence to display listing photos and text on the Website and in marketing of that listing. You must not copy listings, scrape the Website or use our marks without permission.
8. Acceptable use
You must not misuse the Website, attempt unauthorised access, post unlawful or harmful content, discriminate against guests or hosts, or use HimValley to advertise stays that are not listed through the platform.
9. Limitation of liability
To the fullest extent permitted by Indian law, HimValley is not liable for the condition of a HomeStay, host or guest conduct, travel disruption, weather, road access, or loss arising from information supplied by hosts or guests. Our total liability related to a booking will not exceed the fees HimValley actually received for that booking. Nothing in these Terms limits liability that cannot be limited by law.
10. Changes and termination
We may update these Terms and will post the current version on this page. We may change or discontinue parts of the Website. You may close your account subject to any open bookings. We may terminate access where these Terms are broken.
11. Governing law
These Terms are governed by the laws of India. Courts in Himachal Pradesh shall have jurisdiction, without limiting any rights you may have as a consumer under applicable law.
